Terms of Service

1. Eligibility and territory

You must be at least [AGE], reside in an eligible Australian State or Territory, have legal capacity to agree to these Terms, and satisfy the conditions for the relevant promotion. Employees, contractors, administrators, accounts marked as administrative or otherwise ineligible, immediate family members of LevelUp, and anyone involved in administering a draw are ineligible unless the applicable promotion terms expressly state otherwise. We may require reasonable proof of age, identity, residency and eligibility before accepting an entry or paying a prize.

The Service may be viewed outside an eligible area, but entries submitted where participation is unlawful or not offered are void. You are responsible for complying with laws that apply to you.

2. Accounts

You must provide accurate, current information, use only one personal account, and keep your credentials, device and recovery methods secure. You must promptly notify us of suspected unauthorised use. Accounts and entries may not be sold, transferred or shared. You are responsible for activity conducted through your account except to the extent caused by our breach of law or failure to take reasonable care.

About LevelUp

LevelUp is an advertising-supported rewards and entertainment platform. The Service may offer activities, progress, achievements, rewards, games, referrals and other features described in the app. Feature availability, requirements and benefits may vary as the Service develops.

The weekly raffle is an optional, secondary promotional feature of LevelUp. Participation in the raffle is not required to use the Service’s other available features.

3. Weekly raffle promotions and entries

The current weekly-raffle model permits an eligible account to claim one available daily entry and may award disclosed login-streak or activity bonuses. No purchase is necessary and we do not sell entries.

Advertisements support the Service and prize funding, but viewing or completing an advertisement does not grant a raffle entry, increase an entry multiplier, improve a user’s draw odds or otherwise provide an advantage in a cash-prize draw. Advertisement availability has no effect on a user’s ability to claim an available free entry.

Each draw or promotion is also governed by promotion-specific terms displayed before or when entries are offered. Those terms should identify the promoter, eligible territory and age, promotion period, entry limits, draw method/date/place, prize pool and divisions, winner notification/publication, claim and redraw process, permits or authority numbers, and any special conditions. If these Terms conflict with promotion-specific terms, the promotion-specific terms govern that promotion.

An entry is provisional until recorded and validated by our systems. Entries are not money or property, have no cash value, and cannot be transferred. Administrative-account entries, retired entry multipliers and legacy entry balances are excluded from the draw. We may invalidate duplicate, automated, manipulated, fraudulent, technically erroneous or otherwise ineligible entries. A service message, estimate or displayed balance does not override the authoritative draw record.

3A. Prize-pool funding and allocation

LevelUp is advertising-supported. Under the current model, the advertised pool for each weekly raffle is calculated using 40% of eligible estimated Google AdMob earnings recorded during that raffle period, beginning when the preceding Sunday draw completes at approximately 8:00 pm Sydney time and ending when the next draw begins. Earnings are converted to Australian dollars using the configured exchange rate and remain subject to any disclosed cap. Revenue may include eligible advertising formats across the platform and is not attributed to, earned by or held for an individual user.

The displayed pool may increase during the raffle as paid advertising events are reported and may be reconciled before the draw. AdMob earnings are estimates and may later be adjusted by Google. Unless promotion-specific terms state otherwise, the final pool is allocated 50% to Division 1, 25% to Division 2, 15% to Division 3 and 10% to Division 4.

Satarian Games Pty Ltd is responsible for an advertised valid prize in accordance with the applicable promotion terms. A winner’s entitlement is not conditional on Google or an advertiser paying us for a particular impression.

4. Draws, prizes and claims

Current schedules, prize values, divisions and claim periods are stated in the applicable promotion terms. Winners are selected from valid eligible entries using the stated chance-based draw method. Each valid entry has equal weight. Unless those terms state otherwise, a person may win no more than one division in a draw.

Potential winners must complete required verification and provide accurate Australian payment details within the stated claim period. Payment may be made by Australian bank transfer, PayPal or another stated method. We may pause a payment while reasonably investigating eligibility, fraud, sanctions, legal requirements or a payment failure. We will not withhold a valid prize arbitrarily.

Unclaimed, invalid or undeliverable prizes will be handled only as described in the applicable promotion terms and applicable law, including any required redraw or regulator approval. Winners are responsible for obtaining their own tax advice. We do not ask a winner to pay a fee to receive a prize.

5. Fair use and prohibited conduct

You must not use bots, scripts, emulators, multiple accounts, modified devices, false identities, ad farming, location spoofing or other means to obtain an unfair advantage; interfere with security or infrastructure; reverse engineer except where the law permits it; exploit or conceal a defect; manipulate referrals, ads, entries or results; impersonate another person; or use the Service unlawfully. You must promptly report material errors and must not knowingly retain benefits issued by obvious mistake.

Where reasonably necessary and proportionate, we may investigate, quarantine entries, correct records, suspend access or disqualify affected entries. We will consider relevant evidence and provide reasons and a review contact where practicable. Nothing permits us to alter a completed draw or withhold a prize contrary to applicable law.

6. Communications

We may send service, security, draw and prize communications needed to administer your account or a promotion. Optional marketing communications are sent only where permitted by law and may be withdrawn using the message’s unsubscribe method or available account controls. Disabling notifications does not extend a claim deadline stated in promotion terms.

7. Privacy and winner publicity

Our Privacy Policy explains how we handle personal information. Promotion terms may require publication of a winner’s username or surname/initial, State or Territory, prize and draw result to the extent required for transparency or by law. Any additional image, testimonial or promotional use requires consent unless the promotion terms lawfully provide otherwise.

8. Third-party services

The Service depends on Google/Firebase, Google AdMob, app stores, email and payment providers. Their separate terms may apply. We are not responsible for independent third-party services, but this clause does not exclude responsibility that cannot lawfully be excluded. Advertising content is supplied by third parties and is not necessarily endorsed by us.

9. Intellectual property and licence

We and our licensors retain rights in the Service, software, branding and content. We grant you a personal, limited, revocable, non-exclusive, non-transferable licence to use the Service for its intended purpose while these Terms apply. You grant us a limited licence to host and process content you submit only as needed to operate, secure and improve the Service and comply with law.

10. Suspension, termination and account deletion

You may stop using the Service and request deletion at any time. We may suspend or terminate access for a material or repeated breach, fraud, legal or security risk, or where the Service is discontinued. Except in urgent cases, we will use reasonable efforts to give notice and an opportunity to respond. Termination does not remove accrued rights, valid prize obligations or records we must retain by law. See our account deletion page.

11. Availability and changes

We may maintain, improve or discontinue features. We will not retroactively reduce valid entries or prizes for an active promotion except where required by law or permitted under its fixed terms. Material changes to these Terms will be notified reasonably in advance and may require fresh acceptance. Changes do not apply retrospectively unless required by law.

12. Consumer guarantees and liability

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right, remedy or liability that cannot lawfully be excluded, including under the Australian Consumer Law. To the extent permitted by law, the Service is otherwise supplied on an “as available” basis. We are not liable for loss caused solely by events outside our reasonable control, your unlawful conduct, or an independent third party, but this does not limit liability where doing so would be unlawful. Any lawful limitation must be read down to the minimum extent necessary.

13. Complaints and disputes

Contact us first at support@satariangames.com with enough detail for us to investigate. We will attempt to resolve the matter fairly and promptly. You retain any right to contact a regulator, consumer protection body or court.

14. General

If a provision is invalid, it is severed or read down and the remainder continues. A delay in enforcement is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a genuine restructure or sale if your rights are not materially reduced. These Terms and the applicable promotion terms form the agreement about the Service.

15. Governing law and contact

These Terms are governed by the laws of New South Wales, Australia. Subject to any non-excludable rights, the courts of New South Wales have non-exclusive jurisdiction.
